TERMS AND CONDITIONS

Please read these TERMS AND CONDITIONS carefully before purchasing any products or services offered by Brave Idea Sports Consulting LLC (“Brave Idea”). By making a purchase, the USER agrees to all of the terms described herein. 1. OBJECT OF THE CONTRACT

1.1. This agreement governs the offer, acquisition, and use of the following products and services:

  • Prime Consulting: Custom plans designed exclusively for the USER, with training and/or dietary protocols based on the provided information.
  • FIT Plans: Pre-designed training and/or dietary protocols, delivered in digital format within 2 business days after the questionnaire is completed.
  • Brave Journey: A 12‑month subscription providing access to the FIT plan and an online course featuring new monthly protocols.
  • Online Courses: Educational and instructional content in digital format, available through the Brave Portal.

1.2. All services are for personal, non‑transferable use. Sharing, redistribution, or commercialization is prohibited.

2. ACCEPTANCE OF THE TERMS

2.1. Acceptance of these TERMS AND CONDITIONS is mandatory and is formalized electronically by selecting the “I HAVE READ AND AGREE TO THE TERMS AND CONDITIONS” option during the purchase process.

2.2. Once accepted, the USER cannot claim ignorance of the agreed conditions.

3. USER REQUIREMENTS

3.1. The products and services offered are exclusively intended for individuals over 18 years of age who certify that they are physically fit and do not have any medical restrictions that would prevent them from engaging in physical exercise or following dietary plans.

3.2. Contracting Restrictions:

  • Services are not available to pregnant women, regardless of the gestational period.
  • Services are not recommended for individuals with special health conditions (e.g., diabetes, cancer, heart problems, AIDS) without formal medical authorization.

3.3. The USER declares and guarantees that:

  • a) They have no history of heart problems, chest pain, dizziness, or frequent fainting spells.
  • b) They have not been advised to perform physical exercises solely under direct supervision.
  • c) They do not have conditions that could be aggravated by physical exercise or dietary plans.
  • d) They are not pregnant (if applicable).

3.4. If the information provided is false or incomplete, Brave Idea may immediately terminate the agreement without refunding any payments and disclaims all liability.

4. REGISTRATION INFORMATION AND USE OF THE BRAVE PORTAL

4.1. The USER is responsible for providing accurate information during registration and keeping it updated, notifying any changes via email to contact@braveideaconsulting.com

4.2. Access to the Brave Portal is personal and non‑transferable. Sharing credentials or using third‑party information is prohibited and may result in suspension or cancellation of access.

4.3. The USER must safeguard their credentials and immediately report any unauthorized access or suspected security breaches to Brave Idea.

5. SPECIFIC RULES BY PRODUCT OR SERVICE TYPE

5.1. Prime Consulting

5.1.1. The USER will receive a personalized plan based on the registration questionnaire completed on the Brave Portal.

5.1.2. Delivery Deadline: The protocol will be sent up to 2 days before the scheduled start date.

5.1.3. Customization Requirements:

  • The questionnaire must be completed at least 3 days prior to the scheduled start date.
  • If the questionnaire is not submitted on time, the plan will be considered to have started on the scheduled date, and the agreement will terminate 30 days after the start date if the questionnaire is not submitted.

5.1.4. Prohibition of Sharing: The protocol is exclusive to the USER and may not be redistributed or commercialized.

5.2. FIT Plans

5.2.1. FIT Plans are pre‑designed materials provided in digital format within 2 business days after the questionnaire is completed.

5.2.2. Refund and Cancellation Policy:

  • No refunds will be issued after the material is delivered or accessed.
  • The USER may request cancellation with a full refund within 7 calendar days, provided the material has not been accessed or downloaded.

5.3. Online Courses

5.3.1. The USER will gain access to the course on the designated platform upon payment confirmation.

5.3.2. Access Period: The course will remain available for the period specified on the purchase page.

5.3.3. Refund and Cancellation Policy:

  • No refund will be provided after the course begins or the content is accessed.
  • The USER may request cancellation with a full refund within 7 calendar days, provided no course material has been accessed.

5.4. Brave Journey

5.4.1. Pre‑designed materials are provided in digital format within 2 business days after the questionnaire is completed.

5.4.2. Refund and Cancellation Policy:

  • No refunds will be issued for any month after the material is delivered or accessed.
  • The USER may cancel the annual subscription at any time; however, 20% of the remaining installments for the 12‑month period from the first billing will be charged.

6. CANCELLATION POLICY AND TERMINATION

6.1. The USER may exercise the right of withdrawal within 7 calendar days from the purchase date for a full refund, provided that the materials have not been accessed or the services initiated.

6.2. Cancellation Rules for Personalized Consulting:

  • Cancellations made after the protocol is delivered are non‑refundable.
  • If cancellation is requested before delivery:
    • 30% of the paid amount will be retained if requested up to 10 days before the start date.
    • 50% of the paid amount will be retained if requested between 9 and 2 days before the start date.

6.3. Cancellation Rules for FIT Plans and Online Courses:

  • No refunds will be issued after the materials are accessed or downloaded.
  • For courses and plans that have not been accessed, the right of withdrawal applies.
  • For Brave Journey, cancellation will incur a charge of 20% of the remaining value corresponding to the installments for the 12‑month period. After 12 months of subscription, cancellation is possible at any time and future charges will be stopped.

6.4. The agreement will be considered terminated without any refund if the USER:

  • a) Fails to schedule the start date of the personalized consulting plan within 6 months of purchase.
  • b) Fails to submit the completed registration questionnaire within 30 days after the scheduled start date.

7. LIMITATION OF LIABILITY

7.1. Brave Idea does not guarantee specific results from the plans or courses, as they depend on the USER’s dedication and external factors beyond its control.

7.2. Brave Idea is not responsible for technical access issues arising from internet connection failures or device malfunctions.

8. INTELLECTUAL PROPERTY

8.1. All content and materials provided by Brave Idea are protected by copyright and intellectual property rights.

8.2. The USER is prohibited from:

  • a) Sharing, copying, or redistributing the materials to third parties.
  • b) Reverse engineering, creating derivative works, or using the materials for commercial purposes.

9. GOVERNING LAW AND JURISDICTION

9.1. This agreement is governed by the laws of the State of Florida, United States, with the courts of Florida being the designated forum for resolving any disputes.
